Obligation Determination

Identify whether you fall within ETBIS registration perimeter. 2026 penalty band TRY 118,053 – 590,263 (49% revaluation, Official Gazette 33118 / 25.12.2025).

01E-commerce service provider (ETHS) classificationOperating your own e-commerce domain selling directly to consumers? You are an ETHS: ETBIS registration mandatory regardless of volume. (Law No. 6563 Art. 2)

02E-commerce intermediary service provider (ETAHS) classificationMarketplace operator (Trendyol, Hepsiburada, N11, Etsy model) listing third-party sellers? You are an ETAHS: ETBIS registration mandatory plus higher disclosure obligations.

03Sales via Turkish marketplace only: no own siteIf you sell only via Turkish marketplaces (ETAHS) without your own domain, you are not separately required to register with ETBIS: the marketplace handles registration.

04Social media commerce (Instagram, Facebook Shop)Sales via social media platforms with direct shopping features that operate as e-commerce activity require ETBIS registration when sales volume is substantial.

05Mobile app order taking (restaurant, service)Restaurants and service providers taking orders via own mobile apps are within scope; aggregator-mediated orders (Yemeksepeti, Getir) handled by the aggregator.

06Foreign operators selling into TurkeyNon-Turkey-resident ETHS/ETAHS targeting Turkish consumers must appoint Turkey-based representative and register before commencing operations.

07Net transaction volume threshold check (license obligation)Operators above defined net transaction volume thresholds require additional licenses (Article 3: ETHS, Article 4: ETAHS). License obligation effective from 01.01.2025.

08NACE code and trade registry sector verificationYour registered business activity must include e-commerce-relevant NACE codes (47.91 mail-order/e-commerce). Mismatch delays portal access.

Registration Preparation

Documentation needed before opening the eticaret.gov.tr portal: preparation cuts registration to a single session.

09Tax ID and MERSIS number verifiedTax number from Revenue Administration + MERSIS number from Trade Registry. Both required at application.

10e-Signature or e-Government accessApplication via e-Government portal authentication or qualified electronic signature. KEP not required for initial registration.

11Domain ownership documentationWHOIS or registrar records showing domain ownership matches the company. Foreign-domain operators bring proof of legal control.

12SSL certificate activeAll e-commerce sites must operate over HTTPS. Mixed-content or expired SSL configurations cause portal rejection.

13Marketplace intermediary contracts (if dual-channel)If selling via own site + marketplaces, contracts with each ETAHS (Trendyol, Hepsiburada) on file for portal declaration.

14Tax certificate (vergi levhası) readyCurrent-year vergi levhası from GIB, accessible via interaktif vergi dairesi or e-Devlet.

15Trade registry gazette extractTrade Registry Gazette extract showing current registered activities and authorities.

16Authorized signatory documentationSignature circular authorizing the person submitting ETBIS registration; mismatch with portal applicant triggers rejection.

SECTION 3 · 8 ITEMS

Portal Notification

Substantive data populating the public ETBIS record: quality determines public-facing compliance signal.

17Company general information completeTrade name, address, phone, email, KEP address, MERSIS number. Each field must match Trade Registry record.

18Activity categories declaredSpecific product/service categories (electronics, fashion, home appliances, services). Multi-category sellers list each.

19Payment methods listedCredit card, debit card, bank transfer (EFT/havale), digital wallets, cash on delivery, BNPL. Each method’s PSP listed where applicable.

20Delivery methods declaredCargo (Yurtiçi, MNG, PTT, Aras), same-day, last-mile partners. Delivery time SLAs.

21Return and exchange terms14-day right of withdrawal procedure (Law 6502 Art. 48), return shipping cost allocation, exchange policy.

22Customer service contact channelsPhone, email, WhatsApp Business, live chat. Response SLA documented.

23KVKK cross-reference (VERBIS registration)Privacy notice, KVKK compliance documents, VERBIS registration number (if registered). Cross-system data flow declared.

24ETBIS QR code displayed on siteMandatory ETBIS verification badge displayed on website footer (typically) with link to public ETBIS record. (Communiqué Art. 6)

SECTION 4 · 6 ITEMS

Post-Registration Compliance

Registration is the starting line. Ongoing obligations that determine whether registration genuinely shields you from enforcement.

25ETBIS verification badge integrationQR code or badge image displayed on every e-commerce site page, typically footer, linking to ETBIS public record verification.

26Distance sale contract and pre-information form alignedDistance Sale Contract Regulation requires pre-contract information form before order finalization. Order flow UX must include the form.

27Advertising compliance (Consumer Law Art. 61)Truthful, non-misleading advertising; price comparison rules; influencer disclosure requirements; targeted advertising consent.

28ETBIS data update within 30 daysAny change in registration information: activity categories, payment methods, delivery, contact: must be updated within 30 days. (6563 Communiqué)

29Annual net transaction volume reportingOperators approaching license thresholds must monitor and report annual transaction volumes. Crossing threshold triggers ETHS/ETAHS license obligation.

30ETHS/ETAHS license application (if threshold crossed)Operators above Article 3 (ETHS) or Article 4 (ETAHS) thresholds require license from Ministry of Trade. Effective 01.01.2025.

Net volume threshold near: Additional preparation for ETHS/ETAHS license application required. Monitor Ministry timeline.
