On December 3, 2024, in the third episode of “IT Conversations” — the podcast series of the Istanbul Bar Association’s IT Law Commission — our Managing Partner Erdem Mümtaz Hacıpaşaoğlu covered the Crypto-Asset Bill.
The central thesis of the conversation was clear: the Crypto-Asset Bill is laying the foundation of a body of legislation that practitioners and the judiciary in Turkey will be working with for many years; a correct reading of both the theoretical framework and its practical application — from the lawyer’s perspective — is decisive.
Headline items in the bill
The conversation examined the CASP definition and licensing regime, segregation of client assets, director liability, audit obligations, and criminal/administrative sanctions from a practitioner’s lens; the importance of the practical questions the judiciary will face in dispute management was emphasized.
Implications for practitioners
From the lawyer’s vantage point, in addition to CASP structuring and compliance projects, new legal items will move into focus across consumer disputes, KYC/AML compliance obligations, and the data-protection layer.
Highlights from this conversation
- Scope: CASP definition, licensing, client-asset segregation
- Judicial practice: Practical questions in dispute management
- Lawyer perspective: KYC/AML, data protection, compliance
